Summonses Issued in Suit

The local business which filed a civil suit against Branch Banking and Trust Co. (BB&T) earlier this year is now embroiled in a classic case of “hurry up and wait.”
Closing Connection, LLC, a Warrenton-based business owned and managed by John Cheatwood, filed the suit in federal court in Alexandria Jan. 5. Court records indicate summonses were issued to the defendants in the case Jan. 14.
Fairfax attorney Rand Lewis Gelber is representing Closing Connection. He confirmed the summonses have been served. The amount of time a defendant has to respond varies, Gelber said.
“The bank is still within the allotted time it has to respond, so it's a waiting game,” Gelber said last week.
BB&T is being sued for negligence, breach of fiduciary duty and breach of contract. Closing Connection is seeking at least $328,540 in compensatory damages and $1 million in punitive damages.
The suit was filed in connection with alleged wire thefts from the business's escrow account in 2007.
