Two arrested by ATF

Fauquier County Sheriff Charlie Ray Fox Jr. said his agency is aware of and is cooperating in a federal investigation stemming from the arrest of his chief deputy's son earlier this month.

Justin Flohr, the son of Lt. Colonel David Flohr, was arrested on a criminal complaint May 8. He is charged with possessing and transferring of a machine gun, in violation of federal law.

Justin Flohr initially appeared in U.S. District Court for the Eastern District of Virginia in Alexandria May 9. He also had a preliminary and detention hearing on May 13, and was ordered released on his own recognizance.

Fox said he cannot comment on any specifics of the investigation because the ATF is actually handling the case.

Edgar Dominic, the ATF agent in charge of the case confirmed that Flohr and another man whose name has not been released, were both arrested on federal firearms charges as a result of an investigation led by his agency.

The Times-Democrat was unable to get further details of the case as of deadline on Tuesday. According to the U.S. District Court Clerk's Office in Alexandria, the case file has been and remains sealed.

Dominic said his office will work with the court to determine why that is so.

If convicted, Flohr could be fined and/or imprisoned for up to 10 years.

The investigation is ongoing.
